Boone County — A dispute over who controls zoning around Indianapolis Executive Airport no longer includes Boone County.
Monday, the Boone County Commissioners signed off on a agreement that they are no longer parties in a lawsuit between the Hamilton County Aviation Authority and the town of Zionsville.
“The only problem I have with it,” said Commissioner Charles Eaton, “(is that the HCAA) made commitments to Boone County which, I believe, run with the land. (The court document) doesn’t address that.”
Lawyers for the commissioners and the Boone County Area Plan Commission, and for the HCAA, agreed to exclude Boone County from a lawsuit the HCAA filed against Zionsville on Feb. 3. Zionsville has agreed to the exclusion, according to court records.
Issues over the commercial aviation facility erupted almost immediately after Hamilton County bought what was then called Terry Airport, for $6 million, from Raymon Van Sickle in 2006. The airfield has been in continuous operation since 1957.
One issue over zoning control could be the future of the $14 million Union Elementary School, which was built in 2005, under the southern approach to the airfield.
